3.4 Third-Party API Limitations: For plans that require users to connect their own OpenAI API key, the term "unlimited generations" refers to the absence of platform-imposed limits on text generation through our service. However, users remain subject to:

• Any rate limits, usage restrictions, or quotas imposed by OpenAI on their API key

• Costs associated with their OpenAI API usage

• Responsibility for maintaining a valid and active OpenAI API key with sufficient credits

The Pro plan offers truly unlimited API usage through our company-provided API key, eliminating the need for users to manage their own OpenAI API key and associated limitations.

3.5 No Refunds for Third-Party API Limitations: We do not provide refunds in cases where users hit their own OpenAI API limits or encounter issues related to their personal API key status. Such limitations are not a result of our Service's functionality but rather the user's agreement with OpenAI. Users are responsible for monitoring and managing their own API usage and limits when using their personal API keys.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ViralScript AI. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any existing or future media.

5. Limitation of Liability

In no event shall ViralScript AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;

• Any conduct or content of any third party on the Service;

• Any content obtained from the Service; and

• Unauthorized access, use or alteration of your transmissions or content.
